An eviction can occur for many reasons. When the tenant has chosen to break the rules of the property as agreed to and signed in the rental contract, you can attempt to have a discussion first, perhaps reminding the renter of the rules and that their behavior can indeed result in eviction if it continues. If the behavior is violent, they are stealing from other tenants or neighbors, or are committing crimes within your property you may have no choice but to evict them immediately. It’s not easy to do, particularly if the tenant becomes hostile. At that point you can involve law enforcement to help you.

One of the hardest reasons to evict a tenant will be because they cannot pay their rent. Evicting a single mom with children that works hard to make ends meet and just can’t keep up will be a tough eviction. Sometimes life is cruel and a tenant will become very ill or have a debilitating accident that puts a strain on the ability to pay the rent. Unless you are related to the financially strained tenant, you must be careful to treat the property as a business.

There are many cases settled in court where a tenant who has been thoroughly obnoxious and destructive has won large settlements against the landlord due to technicalities. Imagine losing a case like this simply because you didn’t use the correct paperwork or procedure. You can avoid this by knowing the laws as they apply in your location. Remember that every state, city, and county is different so be sure to look up the laws specific to your area.
